Coaching Terms & Conditions

These Terms and Conditions (“Agreement”) govern your purchase and participation in coaching services provided by Annie Hoogendoorn ("Coach"). By completing your purchase on this website, you (“Client”) agree to be bound by the following terms.

1. Services

The Client is purchasing a 1:1 coaching program consisting of six (6) one-on-one coaching sessions conducted virtually via Zoom. Sessions may be scheduled weekly or bi-weekly, depending on the agreed timeline. Each session will last approximately sixty (60) minutes.

The Client will also receive between-session support via Voxer, as outlined in the Coaching Program. All sessions must be completed within one hundred twenty (120) days from the date of purchase.

2. Fees and Payment

The Client agrees to pay the full fee as outlined at the time of purchase, either as a one-time payment or in accordance with a pre-approved payment plan. The Client agrees that all payments are non-refundable, regardless of program completion status.

Failure to make timely payments may result in suspension or termination of services, at the Coach’s discretion. In the event of non-payment beyond fourteen (14) days of the due date, this Agreement may be terminated by the Coach without further notice.

3. Rescheduling

The Client may reschedule a session by providing at least twenty-four (24) hours’ notice. Sessions canceled with less than 24 hours’ notice or missed without prior notice (“no-shows”) will be forfeited and will not be rescheduled.

The Client may reschedule a maximum of one (1) session during a six (6)-week period, or a maximum of two (2) sessions during a twelve (12)-week period.

If the Client arrives late to a session, that time will be forfeited, and the session will still end at the originally scheduled time.

4. Scope of Coaching

A. The Client acknowledges that they are fully responsible for their own physical, mental, and emotional well-being, decisions, and results from the coaching process. The Client agrees that the Coach is not liable or responsible for any outcomes resulting from the coaching services.

B. Coaching may involve exploring various areas of life (including relationships, work, health, finances, and personal growth). The Client is responsible for how they choose to apply any coaching principles or suggestions to these areas.

C. The Client agrees that coaching does not involve diagnosing or treating mental health conditions, as defined by the American Psychiatric Association, and that it is not a substitute for counseling, psychotherapy, mental health care, or medical treatment.

D. The Client agrees to participate fully, communicate openly and honestly, and take an active role in their growth and progress.

E. If the Client feels the coaching process is not aligned with their expectations or needs, the Client agrees to communicate this with the Coach so that appropriate adjustments can be made.

F. The Client agrees to attend each session using a computer or laptop with a reliable internet connection. If technical issues arise, alternate solutions (such as rescheduling or switching to phone) may be offered at the Coach’s discretion.

5. Confidentiality

The coaching relationship and any information shared by the Client is confidential. The Coach will not disclose any information without the Client’s written consent, except where required by law, to comply with a court order, or to prevent serious harm to the Client or others.

6. Recordings

Coaching sessions may be recorded for the purpose of improving the Coach’s services. All recordings will be stored securely and will not be shared with third parties without the Client’s express written consent. The Client may opt out of having sessions recorded at any time, and doing so will not affect the quality or availability of coaching services.

7. Intellectual Property

All coaching materials, resources, and content provided by the Coach are for the Client’s personal use only. The Client is not authorized to share, distribute, reproduce, or license the Coach’s intellectual property.

8. Disclaimer

The Coach is committed to the Client’s success but does not guarantee any specific results or outcomes. The Client acknowledges that results depend on a number of factors, including their own effort, participation, and commitment. Coaching is a collaborative process, and the Coach’s role is to facilitate insight and growth, not to guarantee transformation.

9. Termination

The Coach reserves the right to terminate this Agreement immediately if:

A. The Client engages in behavior that is abusive, inappropriate, discriminatory, or otherwise violates the integrity of the coaching relationship.

B. The relationship of mutual trust and respect between the Coach and Client is compromised.

C. Circumstances beyond the Coach’s control prevent continuation of services.

D. The Client fails to pay an outstanding balance within fourteen (14) days of the due date.

Either party may terminate this Agreement in writing if the other party materially breaches the terms herein. Upon termination, any unpaid fees will remain due.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state of Oregon, United States, without regard to its conflict of law principles.

11. Entire Agreement

This Agreement constitutes the entire understanding between the Coach and Client and supersedes all prior agreements, representations, and understandings, whether written or oral.

12. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
